Terms of service for the MoWeSta applications

We, i.e. the chair of Networked Embedded Systems at the University of Duisburg-Essen, offer you the use of the MoWeSta service free of charge via its web application and/or its mobile applications. If you use the service, you agree to all of the conditions listed below.

Access and connection charges

The service is accessed via the web application or the mobile applications that contact our servers via an internet connection. You pay the connection costs yourself.

Please note that the mobile applications regularly communicate with the service in the background when the temperature detection is switched on. Depending on the mobile phone contract, this can result in very high costs. This applies in particular to roaming abroad.

Usage restrictions

The use of the service is subject to the legal framework. Use for illegal purposes is not permitted. Use that impairs the service for other users is also not permitted.

The service allows the continuous acquisition of temperature, air pressure and location data in the background. Due to the fact that your privacy could be adversely affected by incorrect recording or disclosure of your location data, we exclude use by underage users.

Furthermore, we only allow the use of the mobile application on devices that belong to you and that only you use.

You may only use our applications in situations in which you do not have to concentrate on anything else (such as road traffic while driving).

Your rights

We grant you a personal, royalty-free, non-transferable, non-exclusive, revocable and non-sublicensable license to access the service.

You can stop using the service at any time.

Your duties

You may not change the software that implements the service without our written consent.

Access to your account is protected by a password, which you must keep secret. In your own interest, you should use a secure password and report it to us if you suspect that your password has been lost.

Warranty and disclaimer

We offer the service free of charge and without commercial interest. Our goal is to collect temperature and location data for research purposes by users who want to knowingly share their data with us. In addition, we want to make the work of our students accessible to a wider audience in order to further increase their motivation and interest in the diverse subjects of computer science.

Since we do not make any money from providing the service, we do not make any specific assurances regarding the service. In particular, we make no assurances about the functions, availability or reliability, or the suitability of the service for certain purposes. Furthermore, we only provide the service in its current form.

To the extent permitted by law, we exclude all warranties. To the extent permitted by law, we continue to accept no responsibility for lost profits or income and are not liable for the loss of data. Furthermore, we exclude liability for indirect damage and consequential damage that could arise from the use of the service, insofar as this is legally permissible.

Privacy

The type and scope of processing of your data by using the service are described in our  privacy policy. Please read the privacy policy carefully, because by accepting these terms of use you consent to the processing of your data described there.

Security

We strive to make the service secure for all users. We regularly update our computer systems and encrypt the communication with the service via HTTPS. Unfortunately, however, we are unable to guarantee security.

Termination

We intend to operate the service over a longer period of time. However, we reserve the right to stop the service at any time. As far as possible, we will announce this in advance.

Changes

We reserve the right to change the terms of use of the service. If we do that we will try to inform you about it in advance by email and/or message entries in the service.

Severability clause

If a provision of these terms of use is not enforceable, it is considered to be separable from the other provisions and does not affect the validity and enforceability of the remaining provisions.

Our weather data is copyrighted but freely available data from the Deutsche Wetterdienst , which we call up and process daily as far as possible. Further information on this data can be found on the website of the Deutsche Wetterdienst .

The basis of our map display and our address resolution are the data of the  OpenStreetMap , which  are available  from the OpenStreetMap Foundation (OSMF) in accordance with the  Open Data Commons Open Database License (ODbL)  (© OpenStreetMap contributors).

The map data is visualized with the help of a library for image generation from  Locoslab GmbH .
